Course Description:

This comprehensive seminar will focus on the dental practice and circumstances which can reduce and sometimes prevent increased risks that often lead to malpractice claims. Dentists and staff will be provided with practical suggestions and approaches that can successfully reduce unexpected events which often increase the likelihood of malpractice claims against the dental practitioner. The course is also designed to explore how professional liability policies work and how to improve patient care with the proper risk management protocols. Course topics include management of patient communications, basic principles of accepted chart and record documentation, responsibilities of protecting patient health information, as well as legal concepts, including informed consent, vicarious liability and negligence.

Mark V. Franco, Esq.

Mark Franco is a seasoned litigator with more than 35 years of experience in state and federal courts, advocacy before government agencies, and alternative dispute resolution. He represents clients in a broad range of civil disputes and has specific expertise litigating in the fields of employment, municipal, construction, transportation, maritime, civil rights, defamation/slander, commercial disputes, real property, professional malpractice, personal injury, premises liability, auto liability, and subrogation. Over the course of his career, Mark has managed and tried over a 100 jury trials, as well as many non-jury and administrative hearings.

 

Regarded among his peers for his expertise, Mark has achieved AV Preeminent rating by Martindale-Hubbell. He has also been recognized as part of New England Super Lawyers in personal injury defense, professional liability, and employment law since 2007. Mark is also regularly invited to speak at seminars and training sessions for attorneys and insurance professionals on employment law, professional liability, and trial practice.

 

Mark enjoys spending time with his wife and their grown children. He is an avid golfer and appreciates everything Maine has to offer including the outdoors, excellent food, and vibrant communities. Mark is active in community service and currently serves as President of the Val Halla Golf Association. Formerly, he served as President of the Boards of both the Maine Children’s Cancer Program and Falmouth Little League.

Robert M. Peskin, DDS

Dr. Robert M. Peskin graduated from Stony Brook University School of Dental Medicine in 1977. He subsequently completed General Practice and Dental Anesthesiology Residencies at Long Island Jewish Medical Center. Since 1983, he has maintained a private practice devoted primarily to the management of the anxious, apprehensive, and special needs patients in Garden City, New York. In addition, he provides in-office anesthesia for other dentists throughout the Greater New York metropolitan area. Dr. Peskin’s interest in professional liability insurance began in the mid-1980’s amidst the malpractice insurance crisis that ultimately led to the creation of the claims-made coverage that is the market standard today. During that time, he lectured frequently on malpractice insurance in general and in particular on its impact on coverage for dentists administering anesthesia. In 1986, he began a 16-year tenure on the New York State Dental Association’s (NYSDA) Council on Insurance, and for nearly three decades served on the Underwriting Claims Committee for Medical Liability Mutual Insurance Company. Since 1995 he has presented the NYSDA-endorsed Risk Management® program more than 100 times throughout New York State and has been presenting the Professional Protector Plan’s Risk Management Seminar since 2017. Dr. Peskin is a Clinical Associate Professor in the Department of Oral and Maxillofacial Surgery’s Division of Hospital Dentistry at Stony Brook. He is also a Diplomate of the American and National Dental Boards of Anesthesiology and a Fellow of the American and International Colleges of Dentists, the Pierre Fauchard Academy, and the Academy of General Dentistry. Dr. Peskin has been extremely active within organized dentistry, including the Nassau County Dental Society (his local component), the New York State Dental Association (where he served as Speaker of its House of Delegates for six years) and the American Dental Association. More recently, he was elected Speaker of the House for the Academy of General Dentistry.
